REP. WARREN CHISUM: Thank you Mr. Speaker, members. We have today Kent Jennings as the Associate Pastor at Hyde Park Baptist church has come, and he is also my Sunday school teacher while I'm here in town, so welcome Kent Jennings.

PASTOR OF THE DAY: Thank you very much. Let's pray together. Our Holy Father, we thank you for this day. And, Lord, as we gather today with these fine people and begin a day of business, a day of service for the State of Texas. As we stand in this in this powerful place of government, and as we reflect on the sobering responsibility of these men and women, may we pause and take this moment to acknowledge and praise your greatness and majesty above all. In this moment, Lord, we acknowledge your love and your desire to provide us your very best. We admit that without your wisdom we will likely make choices today that will lead us to disappointment. In our prayer this morning we begin by pleading for your wisdom and direction in every decision and action we take today. May each member in this assembly rely on your wisdom to make 30 very difficult choices facing 30 day. I pray that each member today exhibit 30 courage to listen to your leadership. I pray that each member love you enough to obey you. I pray that each member model 30 characteristics of Christ-like love to each other and, at 30 end of this day may 30 Lord say regarding each of us: He did right in the eyes of the Lord. Father, we are blessed to have men and women of leadership gather here today who take seriously 30 heavy responsibility of leadership in our state. Will you bless them and their families and grant them your favor in the days ahead? In Jesus' name, we pray. Amen.

Dr. Wayne Bockman is a family practitioner here in town. He's going to be helping our nurse, Tim Flynn, to make sure we're all healthy today. And one of the things I want to mention, too, is as a family practice physician it's very important that we have residencies in the State of Texas to keep good people like this here in our state. So we're fortunate here to have him here today. Please welcome Dr. Bockman.

THE CLERK: HR 331 by Lozano. Whereas proud citizens of Kingsville are gathering in Austin on February 9th, 2011, to celebrate at the 30 state capital. And whereas founded on Independence Day, 1905, Kingsville is a home to the world famous King Ranch, which developed 30 cattle breed and has long been a predominant supplier of Quarterhorses. Moreover, 30 ranch is the home of a Triple Crown winner and has been a leader in agriculture for more than 150 years and continues to be one of the largest oil and gas producers in the state. And whereas it is an important center of higher education in south Texas since 1925, Texas A&M University Kingsville includes the College of Engineering, 30 Louis Levert College of Agriculture, the Caesar Cleever Wildlife Research Institute and 30 Texas A&M Health Science Center. The college of Pharmacy, 30 University of Football Championships and has recently been recognized for its excellent environmental engineering program, fine Arts Program, School of Education and Wildlife Society. 30 fine institution's enrollment increased by more than 12 percent in the fall of 2010 and has opened a new dormitory and recreation center. With construction on two or more residence halls and a new dining facility already underway. And whereas Naval Air Station Kingsville features a premier undergraduate pilot training facility in the United States, which prepares U.S. Navy and Marine Corp. for their key role in national defense. Within 30 past two years the base has had an Army Reserve Medic, an evacuation unit and an Armed Forces Reserve center. Moreover, construction has begun in this facility to be used by a Boarder Patrol station in the area. And Kingsville, along with the rest of the county and neighboring Kennedy County is a place of diversified industries thanks to the presidents of companies producing oil, gas, nuclear, wind and solar power, the area's economy has continued to grow resulting in new jobs and an improved quality of life for residents. Among 30 Kingsville business that are presently expanding and employment offering are 30 Texas Cementing Services and ProKoe, Inc. And whereas the City of Kingsville is a region center for health care with an outstanding medical facility, 30 Christas Hospital, Kingsville. And whereas the hard working citizens of Kingsville are building a long tradition of progressive development and their achievements are deserving of special recognition. Now therefore be it resolved that the House of Representatives of the 82nd Texas Legislature hereby recognize February 9th, 2011, as Kingsville Day at 30 State Capitol and extend to the visiting delegations sincere best wishes for a memorable stay in Austin.

REP. JOSE MANUEL LOZANO: Members, thank you very much. Today I'm proud to honor 30 city of Kingsville and Kingsville Day for its tremendous accomplishments in this last century. Today we have members with Kingsville the leadership class, members with the Kingsville business community. And behind 30 podium today, behind 30 Speakers' chair, we have 30 president of Texas A&M University, Kingsville. The Claiborne County cook. Karen Griffith, with Kingsville Independent School District, City Commissioner with the City of Kingsville, and Alice Byers, the Executive Director of the Kingsville Chamber of Commerce. I'm proud, today, to be a part of Kingsville, my home. It is home to the King Ranch, as many of y'all know. It's not only oil and gas and ranching, it is -- it once had a Triple Crown winner, a thoroughbred. It has interest in turf grass, pecan operations. As you know, there's -- they've got a partnership with Ford Motor Company with 30 King Ranch Edition vehicles. We have Texas A&M, Kingsville, which has grown by 12 percent, far exceeding 30 annual growth rate averages of universities. We are home to the hospital which provides excellent health care to its community, and 30 Naval Air Station, Kingsville, which trains our Navy's pilots, which go on to land on carriers and defend our country. Members, I ask you to please join me in welcoming Kingsville in the galley and behind me today with a warm round of applause. (Applause.)

Whereas the Texas Aggregate and Concrete Association was created in 1974 when 30 Texas Ready Mix Concrete 30 Associate -- and the Texas Aggregate Associations were united. And whereas in 30 year since TACA has grown to 200 member companies throughout Texas including 75 percent of the concrete business owners, 100 percent of the cement companies and percent of the aggregate firms. Whereas aggregate, concrete, cement and related industries generate billions of dollars in business and employ thousands of Texas, as part of the commission TACA advocate for sustainable funding levels in state sectors that impact its members, thereby helping to promote economic development and job creation in the Lone Star State. Now therefore be it resolved that the Texas House of Representatives of the 82nd Legislature hereby welcome the Texas Aggregates and Concrete Association to the State Capitol and extend to the visiting deligation sincere best wishes for a meaningful day in Austin. REP. SID MILLER: Thank you, Mr. Speaker. We have some folks with us from Talk of the Day, 30 Texas Aggregate and Concrete Association. This industry is a five billion dollar industry to our state. It employs literally hundreds of thousands, probably, constituents that are affected in every one of our districts. It's, you know -- In times when we have unemployment rates that we do today 30 construction industry employs 15 percent of all Texans, and the materials that are created by this -- by these companies, you know, that are part of 30 Texas Aggregate and Concrete Association are what is keeping Texas employed. And also, you know, with a growing state like we've got, these folks are very committed to environmental needs. And, in fact, environmental from the standpoint that those buildings that are built from concrete materials can be 40 percent more energy efficient than those buildings made with other products. And so, with that, I would move passage, Mr. Speaker.

THE CLERK: HR 285 by Lucio. Whereas 30 residents of Harlingen are 30 gathering in Austin on February 9, 2011, to celebrate Harlingen Day 30 State Capitol. And whereas for the time in 1904 when Mr. Hill chose this site alongside the St. Louis, Brownsville and Mexico Railway as 30 location for a new town. Harlingen was destined to become a crossroads of commerce. 30 first train passed through the rugged settlement that railroad workers called Rattlesnake Junction. Tales of Texas Rangers and Custom Patrol Agents taking target practice next to the rail depot gave Harlingen it's nickname, 30 six shooter junction. And between 1910 to the 1930s the trains brought thousands of Midwestern farmers to set up operations in Harlingen Magic Valley, where they found that they could grow two crops a year. And during World War II the city was home to Harlingen Army Air Field, a facility that grew into Harlingen Air Force Base. And whereas 30 base eventually became Valley International Airport, 30 largest airport in the Rio Grande Valley, which together with the cities in Mexico and 30 port to connect to international waterways, serve to further underscore the community's importance as 30 center for trade. And whereas 30 area's semitropical client, natural resources and friendly people make it a destination for travelers, including winter Texans and birdwatchers and other enthusiasts the communities attractions include 30 memorial 30 Heritage trail and the Historic Downtown District, the numerous sports fields and parks. And Harlingen developed into a regional medical hub with medical facilities that include Valley Baptist, Harlingen Medical Center. Moreover, 30 city has recently become the headquarters of the VA Texas Valley Heathcare Network, which contains a 16,000 square foot ambulatory and surgical facility. And whereas area of residents have long understood the importance of education. And 30 community is home to Texas Technical College, the Marine Military Academy and 30 Regional Academe center of the University of Texas Health Science Center in San Antonio. And whereas this thriving city of 70,000 people is served30 by Mayor Chris Boswell in conjunction with city commissioners, Robert A. Leftwich, Cory Mara, Jerry Scagg and Joey Trevino. And whereas a dynamic community that draws from the richest past and prepares for an exciting future, Harlingen has established itself as an outstanding place to live and work. We take great pride in the area's ongoing achievement. This will close more than a decade of outstanding service to the community. And was over 30 course of the ten years Reggie Williams has guided the foundation in fulfilling his mission to help donors in South Central Texas fulfill their goals of building partnerships of nonprofit organizations. Under his leadership the foundation had established scholarships instituting30 our environmental education programs and provided support to wounded veterans and senior citizens. And whereas after earning a Masters degree in education, Mr. Williams was commissioned as an officer to the U.S. Air Force, and is a graduate of the National Defense University Armed Forces South College and 30 Industrial College of Armed Forces. He retired from the Air Force at 30 rank of colonel and went on to work as the senior vice president of information systems operations at USAA insurance company. And whereas Mr. Williams has served the community as board president of the Rotary Club of San Antonio, chairman of the advisory board of the San Antonio United Negro College Fund and executive chair of USAA Volunteer corps, he has also been an given an adviser to the Board of Alec Austin Community Center and a member of the Compadres of San Antonio Mission, Christa Santa Rosa, 30 College of (inaudible), the United Way of San Antonio in Bexford county, among others. Whereas for many years Reggie Williams has been an inspiring mentor and civic leader in San Antonio earning 30 respect and admiration of countless individuals and his dedication, professionalism and deep compassion have greatly benefited the community. Now therefore be it resolved that the House of Representative of the 82nd Texas Legislature hereby commend Clarence R. Williams on his exemplary service as president and CEO of the San Antonio area foundation and extend their best wishes for continued success. This resolution honors the former president and chief executive officer of the San Antonio Area Foundation, Retired Colonel Clarence Reggie Williams. Reggie led 30 Area Foundation, which is an nonprofit organization in fulfilling its mission helping donors achieve their charitable goals for the greater benefit of the community. RUTH JONES McCLENDON: Reggie performed admirably by developing partnerships between donors and non profit organization and served as a community liaison contributed to the development of facilities such as Haven for Hopes which houses roughly 1,600 homeless persons in need each night. His many contributions include serving as president of the San Antonio Rotary Club, which when he was president was largest Rotary Club in the world. He served as -- also as area governor. He also served as Chair of the advisory board of the San Antonio United Negro College Fund and 30 Executive Chair of the USAA Volunteer Corps. Mr. Williams is also a member of the board of Christa Santa Rosa, United Way in Bear County. And he is joined on the podium by his gracious wife that we affectionally call Buzz. He's also joined by his son, Bradley. And he's also -- with him is Richard and Tony Goldsmith. And Richard Goldsmith, who is a dear friend of mine, I have known him for more than 30 years, he is 30 founder of The Foundation. And with each year Sweetwater Jaycees sponsor the world's largest rattlesnake round up, a three-day extravaganza originally conceived by a group of farmers plagued by an over population of rattlesnakes. And bring their show on the road, group members have come to Austin to offer their fellow Texans demonstrations, information and snake safety, and the even popular snake bedding exhibit. And whereas this informative event is always a favorite at the State capital and it is a pleasure to recognize the Sweetwater Jaycees for another unforgettable presentation. In honor of his dad who we all knew and loved, he caused great havoc up at this podium when I would bring 30 snakes to the Capitol and cause a lot of trouble, and always wanted to get in the picture. So John, in honor of your dad, you can stand. We did honor Chairman Geren, did not bring 30 snakes on the floor but if you would like to go to the open air rotunda they are live and in color. You can learn about snake safety and all kinds of good things. Our governor was already there this morning holding a snake and holding court with all his staff and other people. THE CLERK: HR 182 by Landtroop. Where citizens from Howard County are gathering in Austin to celebrate Howard County Day at the State capital on February 9th, 2011. There is, nestled between 30 Edwards plateaus, the scenic region of the Texas High Plains and the zone to the Big Spring and Sulfur Draw. The nearby town of Big Spring began as a settlement of buffalo hunters in the 1870s. And whereas in Howard County was organized in 1882 with Big Spring as the county 30 situated in the Texas and Pacific Railway. 30 town also became a shipping point for livestock and produce. 30 community was developed as a trading center with 30 arrival of the railroad in the early 1880s. While it was established at the height of the county's oil boom in the 1920s. During World War II Howard County became the site of the Big Spring Army Air Corps Bombardier School, which trained more than 5,000 men. And whereas today Howard County thrives as a center for the petroleum industry, Army and ranching and manufacturing, 30 county looks to the future of energy production with its four wind turbine farms and the expansion of the McMahon Wrinkle Airport. It's further contributing to the area's economy. And whereas 30 regional hub for healthcare and quality education Big Spring is home to veteran's hospitals, a state mental facility and a rehabilitation center; as well as Howard College and The Southwest Collegiate Institute for the Deaf. And whereas visitors and residents enjoy the fine opportunity for recreation of 30 Big Spring State Park. And 30 region's colorful past is celebrated at the Heritage Museum and the Hangar 25 Air Museum. The ongoing redevelopment of Big Spring' newly created downtown further preserves the county's heritage. And whereas they are deeply devoted to their communities and to the land that shaped them 30 people take pride in all that they have accomplished over 30 years, knowing that the robust spirit of generation sis alive and well there. REP. JIM LANDTROOP: Thank you Mr. Speaker. We are here to up recognize February 9th, 2011, as Howard county day at 30 state capital. I would like to begin by recognizing on a dais behind me representatives from Howard County. Dr. Cheryl Sparks, Randy Johnson, Jody Reed, Rodney Bowmar, and Terry Hanson. Now Howard county was organized in 1882 and it got its name after Boney E. Howard, a United States Congressman from Texas. Back in 188130 construction of the Texas Pacific Railway spurred the growth of Big Spring, 30 county seat for Howard County, into a major trading center. Howard County is now a significant farming and oil producing area and is the location of one of the world's largest inland oil refineries, as well as an emerging leader in wind energy. Howard County was also home to Webb Air Force Base, where between 1951 and 1977 hundreds of foreign and over 10,000 U.S. Air Force pilots earned their wings, including our governor, Rick Perry. In addition to the citizens behind me we also have some citizens of Howard county in the south gallery. If you'll please stand as I ask the members to join me in welcoming these great citizens to their capitol on their day. (Applause.)

THE CLERK: HR 125 by Hunter. Whereas proud residents are gathering in Austin to celebrate (inaudible) Day at 30 state capital on February 9th, 2011. This island was first inhabited Indians in the early 1800s. It was frequented by the famed buccaneer, Gene Laveet. The natural pass between 30 island and St. Joseph's Island was originally names (inaudible) and was later named (inaudible) Pass. And whereas in 1885 an English sheep and cattle rancher named Robert A. Mercer built a cabin on the island, at 30 site that later became 30 town. Alezue Harrison (inaudible) started a project to dig the channel across 30 island in 199. The community that grew around 30 new post office was called Grossville. In 1896 it was renamed Tarpon to highlight fine finishing. In 191130 town was official designated as Port Arances. And whereas since WWII 30 port has become one of the most popular resort destinations of the Texas Gulf Coast. 30 superb beaches of the state park draw campers, swimmers and surfers from across the Lone Star State. And 30 town's three lighted piers enable anglers to catch a diversity of fish, including Red Snapper, Shark, Sand Trout, Tuna and Bonito. And whereas Port Arances is also one of the top bird watching destinations in the nation. And 30 Birding Center, 30 Port Arances Wetlands Park and other nature centers afford fine opportunities to view local species such as Herons and Rosy Spoonbills as well as the annual migrations of Hummingbirds, Fly Catchers and Orioles. Whereas 30 rich variety of sea life that resides along the Gulf Coast can be appreciated at 30 University of Texas Marine Science Institute. Visitors also delight in the 30 many fine art galleries, shops, seafood restaurants and hotels, including the historic Tarpon Inn which has hosted such famous visitors as President Franklin Delano Roosevelt and movie star, Hedy Lamar. And was blessed with natural beauty and colorful history Port Arances is one of the jewels of the Lone Star State and its citizens may take pride in their heritage and ongoing achievement. Now therefore be it resolved that House of Representatives of the 82nd Texas Legislature hereby recognize February 9th, 2011, as Port Arances Day at the State Capitol and extend to the visiting delegations sincere best wishes for a meaningful and memorable visit to Austin.

Whereas memories of a life filled with joyful times and dedicated service remain to comfort 30 family and friends of Richard Reese Winaker of Grapevine who passed away on August 25th, 2010 at 30 age of 54. And was barn in Tulsa, Oklahoma on August 2nd, 1956. Rich Winaker joined the Cub Scouts at the age of 8 beginning a lifetime affiliation with the Boy Scouts of America. He was an Eagle Scout and attained a rare level. As an adult. He volunteered countless hours as an assistant scout master, sharing his knowledge, humor and compassion with the boys of Troop 28 in Colleyville. And whereas in 1984 he married Sonja Lean Kirby, and their family grew to include sons Adam, Cory and Jacob. And whereas Mr. Winaker attended and was employed by Oklahoma State University, then worked as a30 mainframe software assistance engineer for BNSF Railway Company and IBM. And whereas an active member of the First United Church of Grapevine, Rick Winaker lived a caring and purposeful life. He enjoyed spending time outdoors following Texas high school football and working with communication technology. And he will be forever remembered with great affection by all those who were priveledged to share his love and friendship. Now therefore be it resolved that the House of Representatives of the 82nd Texas Legislate hereby pays tribute to the life of Richard Reeves Winaker and extends sincere condolences to the members of his family, to his wife, Sonja Kirby Winaker, to the sons, Adam Winaker, Cory Winaker and Jacob Winaker. To his mother, Shirley Winaker, to his brother Phil Winaker, to his sister, Lori Thompson, and to his other relatives and friends. And be it further resolved that an official copy of this resolution be prepared for his family. And that when 30 Texas House of Representatives adjourns this 30 day it do so in memory of Rich Winaker.

REP. SMITH: Members, you have heard 30 memorial resolution honoring 30 life of Rich Winaker. Rich's passions in life were his family and scouting. He joined the Cub Scouts when he was eight years old and went on to become an Eagle Scout at seventeen. Rich even went on to attain 30 Boy Scouts Order of the Arrow Virgil Honor, which is 30 highest honor that 30 Boy Scouts can bestow upon its members. He dedicated himself as an adult scout leader for 13 years with Troop No. 28 in Colleyville, and helped shaped the character of every scout, including my Eagle Scout son, Spencer. Rich lived the scouting oath to do his best, to do his duty to help others at all times, to keep himself physically strong and morally straight. On the speaker's podium today we are privileged to have joining us his family and a friend. First of all, his wife, Sonja Winaker, and his two sons Adam and Cory. Jacob, his third son, is not able to be with us today; along with a family friend, David Ball, who is also a member of the troop. I want to thank 30 Winakers for being here today so that the House of Representatives can honor his memory and say thank you for all the wonderful things that Rich did in his life. I move adoption.

They are the stewards of the Olivewood Cemetery in Houston. And the Olivewood Cemetery is an historic cemetery where the early African-American community in Houston, a lot of its members and its leaders are buried, and these stewards are with us here today in the east gallery. And if they will stand? They are Deborah Blalock Sloan, Charles Cook, Alex Rutledge, June Gay and Shaterra Green. And so while we're in recess -- We have a resolution for you which we're going to read right now, but since we're -- We're standing at ease so we can't actually pass it, but we will do it when we come right back. Wheres the descendents of Olivewood organization has done an exemplary job of highlighting the rich history of Olivewood Cemetery in Houston, and its efforts have helped the burial ground to be recognized on the 2011 most endangered places registered kept by preservation in Texas, which focuses on the sites of significant interests around the state. And whereas first incorporated in 1875, Olivewood is one of the oldest known plated cemeteries in Houston. And it served the early African-American community for a century. Originally laid out with 444 family plots containing more than 5,000 burial spaces, it was expanded in 1917 and the cemetery was the final resting place for former slaves, laborers, military veterans and pivotal leaders of Houston's post emancipation African-America population. Among those buried there are the first black Ordained Methodist Minister in the United States, the Reverend Elias Dibble of Trinity Methodist Episcopal Church, as well as businessman, James B. Bell; educator, James B. Ryan; physician, Russell F. Farraro and dentist, Milton A. Baker. And as the burial grounds also features examples of pre-emancipation in term and practice, such as upright (inaudible) symbolizing the path between the worlds of the living and the dead. Seashells as grave ornaments and text which is upside down or backward letters used in some African cultures to signify death. And founded in 2003, The Defendants of Olivewood is a nonprofit organization dedicated to the reclamation of the cemetery for the benefit of current and future generations of Houston residents. The group maintains committees focused on the restoration, history, public relations, fundraising, security and engineering issues. And it succeeded in obtaining a Texas Historical Marker for the cemetery in 2009. In addition to the cemetery's inclusion on the 2010 Most Endangered Places List. And whereas this provides a valuable link to crucial chapters of Houston history. And the descendents of Olivewood are now doing important work to ensure that the legacy of their ancestors is not forgotten. Now therefore be it resolved that the House of Representatives of the 82nd Texas Legislature hereby honor the Defendants of Olivewood for their efforts to preserve Olivewood Cemetery in Houston. And extend to the members of that organization sincere best wishes for continued success in their worthy endeavor. And be it further resolved that an official copy of this resolution be prepared for the Defendants of Olivewood as an expression of higher regard by the Texas House of Representatives.

Like you, I am eager for the committees to begin work on important legislation and for you to collaborate on the issues that matter most to our state. Today I am referring hundreds of Bills to the committees so that the House can begin to immediately work on these critical issues. I know that we will rise to the occasion and govern in a way that is respectful and continues to make Texas proud. Thank you.

In consideration of issues raised relating to the interrelation of the powers and duties of the federal and the state government and in recognition of the powers reserved to the state and the people under the 10th Amendment of the Constitution of the United States pursuant to Rule 1, Section 16 of the House rules. 1, Joe Straus, Speaker of the House, create the House Select Committee on State Sovereignty. The committee shall monitor actions of the federal government, including the legislation and regulation that create compulsory federal legislation that direct states to comply with serving actions or pass legislation. The committee shall also monitor federal legislation or regulations that condition the provision of federal funding on the requirement that a state take any other action. The committees shall also study, review and hear legislation to refer to it relating to emerging issues relating to interaction between the state and federal government, including issues relating to the proposed amendments to the United States Constitution for a call for a national convention to propose an amendment to the United States Constitution. Furthermore, the committee shall investigate the efforts undertaken by other statutes, states in the same areas. In recognition of the justifiable reliance that all Texans should have in the integrity of the elections and recognition of the fact that the Governor has declared legislation to require the voter to present proof of identification as an emergency pursuant to Rule 1, Section 15 of the House Rules; Joe Straus, Speaker of the House, created the House Select Committee on Voter Identification and Voter Fraud. The committee shall study, review and hear legislation related to voter identification and has designated as an emergency by the Governor of Texas. The committee shall study, review and hear legislation related to the issuance and handling of ballots during an election, including issuance of ballots during early voting, during any write in process or during any election tier, including election date. The committee shall also study issues related to voter fraud. It is the Chair's intent that the committee act on these charges as expeditiously as possible. And to ensure prompt consideration of any ensuing legislation by the entire House. The committee shall have nine members.
